1. Purpose
This Acceptable Use Policy ("AUP") governs your use of Wakeuper ("the Service"). By using the Service, you agree to comply with this AUP. Violation may result in account suspension or termination.
2. Prohibited Activities
2.1 Illegal Activities
You must NOT use the Service to:
- Engage in or promote illegal activities
- Violate any applicable laws, regulations, or ordinances
- Infringe on intellectual property rights, privacy rights, or other rights
- Distribute child sexual abuse material (CSAM) or content depicting minors in harmful situations
- Facilitate human trafficking, terrorism, or other serious crimes
2.2 Abusive Content
You must NOT upload, transmit, or distribute:
- Malware or Harmful Code: Viruses, trojans, worms, ransomware, spyware, or malicious scripts
- Spam: Unsolicited bulk email or messages sent without recipient consent
- Phishing: Deceptive content designed to steal credentials or personal information
- Harassment: Content that threatens, bullies, stalks, or intimidates individuals or groups
- Hate Speech: Content that promotes violence or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Violent or Graphic Content: Gratuitously violent, gory, or disturbing imagery
- Adult Content: Pornographic or sexually explicit material (unless explicitly permitted by your account type and local laws)
- Deceptive Content: Fraudulent, misleading, or impersonating content
2.3 Service Abuse
You must NOT:
- Overload Systems: Attempt to overwhelm our infrastructure through excessive requests or resource consumption
- Bypass Limitations: Circumvent account limits, quotas, or technical restrictions
- Unauthorized Access: Attempt to access accounts, data, or systems you are not authorized to access
- Reverse Engineer: Decompile, disassemble, or reverse engineer the Service
- Scrape or Crawl: Use automated tools to extract data from the Service without permission
- Resell or Redistribute: Resell, sublicense, or redistribute the Service without authorization
2.4 Email Abuse
You must NOT use the Service to:
- Send spam or unsolicited commercial email
- Send emails without proper unsubscribe mechanisms (where required)
- Forge email headers or impersonate senders
- Send emails to purchased, rented, or harvested email lists
- Violate anti-spam laws (CAN-SPAM, GDPR, PECR, etc.)
- Send emails that violate third-party terms of service
2.5 Network Abuse
You must NOT:
- Launch denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Conduct port scanning or network probing without authorization
- Intercept or monitor data without authorization
- Use the Service as a proxy or VPN to mask identity for malicious purposes
2.6 Intellectual Property Violations
You must NOT:
- Upload copyrighted material without authorization
- Distribute pirated software, media, or content
- Violate trademark, patent, or trade secret rights
- Remove or alter copyright notices or watermarks
3. Reporting Violations
3.1 How to Report
If you become aware of content or activity that violates this AUP, please report it to:
- Email: abuse@wakeuper.com
- Subject Line: "AUP Violation Report"
- Include: Detailed description, evidence (URLs, timestamps, screenshots), and your contact information
3.2 Our Response
- We will investigate reported violations promptly
- We may request additional information from you
- We will take appropriate action, which may include content removal, account suspension, or termination
- We may cooperate with law enforcement as required by law
3.3 False Reports
Submitting false or malicious reports may result in restrictions on your account.
4. Enforcement
4.1 Investigation
We reserve the right to:
- Investigate suspected violations
- Access and review account content when necessary for enforcement
- Cooperate with law enforcement and regulatory authorities
- Disclose information as required by law or to protect our rights
4.2 Remedies
Upon detecting or being notified of violations, we may:
- Issue a Warning: For minor or first-time violations
- Suspend Account: Temporarily restrict access pending investigation or corrective action
- Terminate Account: Permanently close accounts for serious or repeated violations
- Remove Content: Delete files or data that violate this AUP
- Report to Authorities: Notify law enforcement for illegal activities
4.3 No Refunds
Account suspension or termination for AUP violations does not entitle you to refunds.
5. Content Responsibility
5.1 User Responsibility
- You are solely responsible for the content you upload, transmit, or distribute through the Service
- You must ensure your use complies with all applicable laws and regulations
- You must respect the rights of third parties
5.2 No Monitoring Obligation
- We do NOT actively monitor user content
- We do NOT pre-screen uploads
- We act on reported violations and detected abuse
5.3 No Liability
- We are NOT responsible for user-generated content
- We are NOT liable for damages arising from content violations by users
6. Compliance with Laws
6.1 Data Protection
You must comply with data protection laws when using the Service, including:
- GDPR (EU General Data Protection Regulation)
- CCPA (California Consumer Privacy Act)
- PECR (UK Privacy and Electronic Communications Regulations)
- Other applicable privacy and data protection laws
6.2 Anti-Spam Laws
You must comply with anti-spam regulations, including:
- CAN-SPAM Act (United States)
- CASL (Canada's Anti-Spam Legislation)
- GDPR (for email marketing in the EU)
- Obtain proper consent before sending commercial emails
- Provide clear unsubscribe mechanisms
6.3 Intellectual Property
Respect copyright, trademark, and other intellectual property laws in all jurisdictions where you operate.
6.4 Export Controls
Comply with export control and sanctions laws. Do not use the Service to export controlled data or technology to prohibited countries or entities.
7. Third-Party Services
7.1 SMTP Providers
- You are responsible for complying with the terms of service of any SMTP providers you use with Wakeuper
- Violations of third-party terms may result in restrictions on your Wakeuper account
7.2 Email Recipients
- Ensure you have appropriate consent and legal basis to send emails to recipients
- Respect recipient preferences and unsubscribe requests
8. Security Best Practices
8.1 Account Security
- Use strong, unique passwords
- Enable two-factor authentication if available
- Do not share account credentials
- Monitor account activity for suspicious behavior
8.2 Data Security
- Encrypt sensitive data before uploading
- Do not upload credentials, API keys, or secrets in plain text
- Be mindful of data you upload and who has access
9. Changes to This Policy
- We may update this AUP at any time
- Material changes will be communicated via email or in-app notification
- Continued use after changes constitutes acceptance
